Three face Criminal Code and CDSA charges; here’s what the offences mean and potential penalties

WINNIPEG — The North District Community Support Unit (CSU) has arrested seven people after a drug-trafficking investigation in the William Whyte neighbourhood led to a search warrant at a residence in the 500 block of Manitoba Avenue on October 19, 2025 (just before 2:00 p.m.).

The operation was supported by the Tactical Support Team and the Guns and Gangs Unit.

Seizure (file: C25-249664):

  • Sawed-off .22 calibre rifle

  • .22 calibre ammunition

  • Fentanyl: 2.7 g (est. street value $325)

  • Methamphetamine: 2.0 g (est. street value $200)

  • Psilocybin: 3.2 g (est. street value $30)

  • Canadian currency ~ $4,000

Police say seven individuals were located inside and arrested. Three now face charges; four were released without charges.

Accused & Charges

1) Nicholas James LILKE, 38Detained in custody

  • Possession of a Loaded Prohibited or Restricted Firearm (Criminal Code s.95(1))

  • Store Firearm or Restricted Weapon Contrary to Regulations (Criminal Code s.86(2))

  • Possession of a Firearm Knowing its Possession is Unauthorized (Criminal Code s.92(1))

Potential penalties on conviction:

  • s.95(1): indictable, up to 10 years in prison. (Recent reforms mean judges generally have full discretion on sentencing.)

  • s.86(2): hybrid; indictable up to 2 years, or summary up to 2 years less a day.

  • s.92(1): indictable, up to 10 years.

2) Male, 48Released on an Appearance Notice

  • Fail to Comply with Condition of Undertaking ×2 (Criminal Code s.145(4))

Potential penalties: Hybrid; indictable up to 2 years, or summary up to 2 years less a day.

3) Female, 30Released on an Undertaking

  • Possession for the Purpose of Trafficking – Methamphetamine (CDSA s.5(2), Schedule I)

  • Possession for the Purpose of Trafficking – Psilocybin (CDSA s.5(2), Schedule III)

  • Possession for the Purpose of Trafficking (a further count under CDSA s.5(2); substance as alleged)

  • Proceeds of Property Obtained by Crime Under $5,000 (Criminal Code s.354(1)/s.355(b))

  • Unauthorized Possession of a Prohibited Weapon (Criminal Code s.91)

  • Possession of a Prohibited or Restricted Firearm with Ammunition (Criminal Code s.95(1))

  • Store Firearm or Restricted Weapon Contrary to Regulations (Criminal Code s.86(2))

  • Possession of Property Obtained by Crime Under $5,000 (Criminal Code s.354(1)/s.355(b))

Potential penalties on conviction:

  • CDSA s.5(2) – Schedule I (meth / fentanyl): indictable up to life imprisonment; summary options exist for lower-end cases at Crown discretion.

  • CDSA s.5(2) – Schedule III (psilocybin): hybrid; indictable up to 10 years, or summary up to 18 months.

  • Proceeds/Property Under $5,000 (s.354/355(b)): hybrid; indictable up to 2 years, or summary up to 2 years less a day.

  • s.91 (unauthorized possession): hybrid; indictable up to 5 years, or summary up to 2 years less a day.

  • s.95(1): indictable, up to 10 years.

  • s.86(2): hybrid; indictable up to 2 years, or summary up to 2 years less a day.

Note: Sentences depend on the facts of the offence, aggravating/mitigating factors, and prior record. Courts may also order firearms prohibitions, forfeiture, probation, and restitution where applicable.

The Winnipeg Police Service reminds the public that the four other individuals arrested were released without charges at this time. Investigators continue to assess evidence gathered during the search.
