SIU Finds No Police Fault in December 2023 Death

Thunder Bay, ON (July 17, 2025) — On July 14, 2025, the Special Investigations Unit (SIU) released its Director’s Report into the December 30, 2023, death of 23-year-old Jenna Ostberg, concluding that no officer was at fault. The ruling follows an 18-month probe sparked by three unanswered 911 calls that morning.

Family Highlights Unanswered 911 Calls, History of Neglect

In a strongly worded statement, Jenna’s parents, Melanie Beardy and Vincent Ostberg, expressed profound disappointment. They argue the SIU failed to account for critical circumstances surrounding their daughter’s death and point to what they state is the Thunder Bay Police Service’s documented pattern of failing to protect First Nations residents.

“We have waited for this report since January 2024…hoping for answers and accountability. The SIU report does not reflect the full person Jenna was…We have no confidence in their ability to properly investigate deaths or ensure the safety of First Nations people,” the Ostbergs said in a statement issued by their Legal team.

They reiterated their commitment to “fight for our daughter” and keep her voice alive, saying the family will not rest until “all parties who potentially had a role in Jenna’s death” are held to account.

Legal Counsel to Review Report, Chart Next Steps

Julian Falconer of Falconer LLP — legal counsel for the Ostbergs — stated the family will require more time “to study the SIU’s report and consider their next steps.” He emphasized that, had police answered the first 911 call and followed protocol, “Jenna would be alive today.”

Family Holds Firm, Mulls Further Action

The family is still reviewing the 150-page SIU report and exploring legal options. No further comments will be issued until decisions on potential civil or judicial review processes are made.
